NOTICE OF FORECLOSURE
Default having been made in the payment of the indebtedness secured by that certain mortgage dated the 25th day of January, 2017, executed by Tammy Howton to Bernice C. Gray by and through Bernice C. Gray’s Power of Attorney Sherrie R. Greathouse and said Durable Power of Attorney being recorded in mortgage book 614, Page 680 on January 26, 2017 of the mortgage records in the Office of the Judge of Probate of Winston County, Alabama. A Corrective Mortgage was signed by Tammy Howton to Bernice C. Gray by and through Bernice C. Gray’s Power of Attorney Sherrie R. Greathouse and said Durable Power of Attorney being recorded in mortgage book 632, Page and Page 701. Both the Mortgage and Corrective Mortgage were assigned to David M. Greathouse and Sharrie R. Greathouse and recorded in Mortgage Book 638, Page 158 and recorded in the Winston County Probate Judge’s Office. The undersigned, David M. Greathouse and Sharrie R. Greathouse have elected to declare the entire indebtedness secured by the said mortgage to be due and payable as provided in said mortgage, and notice is hereby given that pursuant to law and the power of sale contained in said mortgage, the undersigned will sell at public outcry, to the highest bidder for cash, in front of the front or main door to the Winston County Courthouse at Double Springs, Alabama, within the legal hours of sale on 9th day of September, 2019, the following described real estate, situated in Winston County, Alabama, to-wit:

North 00 degrees, 18 minutes, 18 seconds West 136.00 feet to a found ½" Rebar; thence South 85 degrees, 14 minutes, 23 seconds East, 83.00 feet, to a found ½" rebar thence North 13 degrees 47 minutes 22 seconds East 23.09 fee to the point of beginning; thence South 71 degrees, 18 minutes, 19 seconds East 15.43 feet to a set ½" rebar; thence North 18 degrees, 50 minutes, 57 seconds East 28.18 feet to a set ½" rebar; thence North 72 degrees 56 minutes, 16 seconds West 17.88 feet to a set ½" Rebar; thence South 13 degrees, 47 minutes, 22 seconds West, 27.77 feet to the Point of Beginning. A parcel of land in the SE1/4 of SW1/4, Section 24, Township 11, Range 7 West more particularly described as follows:
Begin on the North right of way line of the Gibson Road at a point which is 210 feet East of the point where said right of way line intersects the West line of said forty; thence North a distance of 136 ft. to the point of beginning of the tract to be conveyed herein; From this point of beginning continue North a distance of 74 feet; thence East parallel with the North right of way line of the Gibson Road a distance of 100 feet; thence in a southeasterly direction a distance of 60 feet at such an angle to arrive at a point 83 feet East of the point of beginning; thence East a distance of 83 feet to the point of beginning.
Grantee herein is also granted a right of way as a means of egress and ingress to the lands conveyed herein out to the Gibson Road and is to follow the path of an already existing right of way leading from this property through the property of Gladys and Patrick R. Anderson out to the Gibson Road.
This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the Office of the Judge of Probate of the county where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
Said sale is made for the purpose of paying the same indebtedness and the expenses incident to this sale, including a reasonable attorney’s fee.
