ORDINANCE #2017-08
AN ORDINANCE ESTABLISHING VOTING AND POLLING PLACES FOR ALL MUNICIPAL AND SCHOOL ELECTIONS FOR THE CITY OF HALEYVILLE, ALABAMA.
WITNESSETH THESE RECITALS:
WHEREAS, Alabama law at Title 11-46-21, Code of Alabama, 1975, provides that the regular municipal elections in cities and towns in Alabama shall be held on the fourth Tuesday in August 1984, and quadrennially thereafter and, when necessary as provided in subsection (d) of Title 11-46-55, a second or runoff election shall be held on the sixth Tuesday next thereafter following said regular election; and
WHEREAS, Alabama law at Title 11-46-24, Code of Alabama, 1975, requires the municipal governing body designates voting places for municipal elections; and
WHEREAS, County and City elections are currently being held at the 21st Street Gym located and the Neighborhood Facility Building, and
WHEREAS, Ordinance #2012-02 is hereby amended as follows:
WHEREAS, on the 6th day of November, 2017, the Mayor and City Council adopted and approved Ordinance #2017-08 to relocate the existing polling and voting site at the 21st Street Gym to the Senior Citizen Center located at 2622 14th Avenue; and
WHEREAS, the Winston County Board of Registrars and the Winston County Commission investigated and has determined it is in the best public interest to relocate the existing polling location from the 21st Street Gym to The Senior Citizens Center located at 2622 14th Avenue; and
NOW, THEREFORE, BE IT RESOLVED AND ORDAINED BY THE CITY COUNCIL OF THE CITY OF HALEYVILLE, ALABAMA, AS FOLLOWS:
The Two (2) voting and polling places for all municipal and school elections for the City of Haleyville, Alabama, shall be at the following sites:
Neighborhood Facility Building (NFB): One voting and polling place for municipal elections in the City of Haleyville, Alabama shall be at the Neighborhood Facility Building located at 1205 10th Avenue, Haleyville, Alabama for all qualified electors who live south of Alabama Highway 195 and/or live west of Alabama Highway 13.
Senior Citizen Center: One voting and polling place for municipal elections in the City of Haleyville, Alabama shall be at the Haleyville Senior Citizens Center located at 2622 14th Avenue, Haleyville, Alabama for all qualified electors who live north of Alabama Highway 195 and east and north of Alabama Highway 13.
Any and all ordinances or resolutions in conflict with this ordinance are hereby repealed.
If any part, section or subdivision of this Ordinance shall be held unconstitutional or invalid for any reason, such holding shall not be construed to invalidate or impair the remainder of this Ordinance which shall continue in full force and effect notwithstanding such holding.
This Ordinance shall become effective upon approval and adoption in its publication and/or posting as required by Alabama law.
