Default having been made in the payment of the indebtedness secured by that certain mortgage given by JERRY L HOCKING, A Single Man AND SHELBY CLEVELAND, A Single Woman to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for American Portfolio Mortgage Corporation, dated August 25, 2023, and recorded in Book 2023 at Page 2395 on August 29, 2023, in the Office of the Judge of Probate of Winston County, Alabama, as last transferred to Freedom Mortgage Corporation by assignment, recorded on September 9, 2025, in Book 2025, at Page 6839 in the Office of the Judge of Probate of Winston County, Alabama, conveying the after-described property to secure a Note in the original principal amount of One Hundred Ninety-Two Thousand Five Hundred Forty-Seven and 0/100 dollars ($192,547.00), with interest thereon as set forth therein. Brock and Scott, PLLC, as counsel for Mortgagee or Transferee and under and by virtue of power of sale contained in the said mortgage will, on January 27, 2026, sell at public outcry to the highest bidder for cash at the main courthouse entrance of Winston County, Alabama, within the legal hours of sale, the following described property:
A tract of land lying in the NE 1/4 of NW 1/4 of Section 8, Township 11, Range 6 West, Winston County, Alabama, and being more particularly described as follows:
Commence at the NW corner of said NE 1/4 - NW 1/4 and run thence S 0 degrees 37’ W, along the West boundary of said forty, 259.15 feet to the center of Fire Tower Road and the Point of Beginning of the tract to be described herein; run thence along Fire Tower Road as follows: S 60 degrees 26’ E, 84.68 feet; S 60 degrees 55’ E, 163.08 feet; S 62 degrees 32’ E, 211.82 feet; S 56 degrees 47’ E, 118.33 feet; S 44 degrees 38’ E 116.37 feet; S 37 degrees 18’ E, 102.34 feet; S 27 degrees 31’ E, 101.55 feet; S 17 degrees 42’ E, 32.75 feet; run thence N 88 degrees 32’ W, 709.98 feet to the West boundary of said NE 1/4 - NW 1/4; run thence N 0 degrees 37’ E, 551.01 feet to the Point of Beginning. Less and except the right-of-way of Fire Tower Road. Subject to building and setback lines, restrictions, covenants and conditions of record. Mining and mineral rights excepted.
The debt secured by said Mortgage has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Mortgage. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Mortgage and by law, including attorney’s fees.
This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the Office of the Judge of Probate of the County where the above-described
property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances.

To the best knowledge and belief of the undersigned, the party in possession of the property is Jerry L. Hocking and Shelby Cleveland or tenant(s); and said property is more commonly known as 430 County Rd 52, Arley, AL 35541.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) final confirmation and audit of the status of the loan with the holder of the mortgage and (3) any right of redemption or other lien not extinguished by foreclosure.
