FORECLOSURE NOTICE
Default having been made in the payment of the indebtedness secured by that Mortgage dated October 26, 2023, in favor of Citizens Bank & Trust, a corporation, and executed by Cyber Broadband, Inc., an Alabama corporation, which Mortgage is recorded October 30, 2023, in Book 2023, Page 4235, Assignment of Rents recorded October 30, 2023, in Book 2023, Page 4244, and Second Mortgage recorded August 12, 2024, in Book 2024, Page 5123, all in the Probate Office of Winston County, Alabama, the mortgagee has elected to declare the entire indebtedness secured by said Mortgage to be due and payable as provided in said Mortgage, and notice is hereby given that pursuant to the law and power of sale contained in said Mortgage, the undersigned will sell at public outcry to the highest bidder for cash at the front doors of the Winston County Courthouse at Double Springs, Alabama, at the legal hours of sale, April 30, 2026, the following described real estate situated in Winston County, Alabama, to-wit:
PARCEL 2: Commencing at a ½” pipe found and purported to be the northeast corner of the NW ¼ of the SE ¼ of Section 29, Township 9 South, Range 10 West, Winston County, Alabama; thence South 89° 36’ 03” West a distance of 25.26 feet to an iron pin set on the west margin of Elizabeth Street, the point of beginning for the property herein described; thence along said margin North 05°31’27” East a distance of 114.90 feet to a point; thence continue along said margin North 01°13’21” West a distance of 34.50 feet to an iron pin set; thence leaving said margin South 89°36’00” West a distance of 316.48 feet to an iron pin found; thence South 00°32’43” East a distance of 148.79 feet to an iron pin found; thence North 89°36’03” East a distance of 84.66 feet to an iron pin found; thence North 89°36’02” East a distance of 220.29 feet to the point of beginning

Said sale is being made for the purpose of applying the proceeds to the debt secured by the mortgage and the expenses of foreclosure. The auctioneer will give to the purchaser an Auctioneer’s deed subject to ad valorem taxes due October 1, 2025 and October 1, 2026, subject to any and all statutory rights of redemption, previous mortgages, if any, all easements, encroachments, unrecorded leases, if any, any rights of way for road, or otherwise, utilities, title to all minerals and all restrictions and covenants of record.
