A parcel of land lying in the NE 1/4 of the NW 1/4 of Section 2, Township 12 South, Range 7 West of the Huntsville Meridian, Winston County, Alabama, being more particularly described as follows:
Commence at the SE corner of the West 1/2 said NE 1/4 of the NW 1/4, thence run N 1 degree 04 minutes 15 seconds E along the east boundary of the West 1/2 said NE 1/4 of the NW 1/4 a distance of 150.00 feet to the NE corner of that parcel recorded in Volume 316 Page 555 and the POINT OF BEGINNING; thence run N 89 degrees 19 minutes 35 seconds W along the north boundary of that parcel recorded in Volume 316 Page 555 a distance of 105.00 feet to the NW corner of that parcel recorded in Volume 316 Page 555; thence run S 1 degree 04 minutes 15 seconds W along the west boundary of that parcel recorded In Volume 316 Page 555 a distance of 113.20 feet to a point; thence run S 43 degree 37 minutes 30 seconds W along the west boundary of that parcel recorded in Volume 316 Page 555 a distance of 50.27 feet to a point on the north right-of-way boundary of County Road 16; thence run in a northwesterly direction along said right-of- way boundary a distance of 690 feet, more or less, to the NW corner of that parcel recorded in Volume 171 Page 748; thence run S 78 degrees 50 minutes 35 seconds East distance of 357 feet, more or less, to the NW corner of that parcel recorded in Volume 333 Page 246; thence run S 1 degrees 04 minutes 15 seconds W along the west boundary of that parcel recorded in Volume 333 Pag 246 a distance of 100.00 feet to a point; thence run S 78 degrees 50 minutes 35 seconds East distance of 150.00 feet to the SE corner of that parcel recorded in Volume 333 Page 246 and also on the east boundary of the West 1/2 said NE 1/4 of the NW 1/4; thence run S 1 degree 04 minutes 15 seconds W along the east boundary of the West 1/2 said NE 1/4 of the NW 1//4 a distance of 137 feet, more or less, to the POINT OF BEGINNING. Said parcel containing 3.7 acres, more or less. Subject to any other easements, covenants, restrictions and reservations on record. TO: All heirs and owners of the following described property and to the heirs and devisees, if deceased, whose whereabouts are unknown and which cannot be ascertained after the exercise of reasonable diligence.
You are hereby notified that on the 30th day of January, 2024, a complaint to quiet title in rem was filed in the Circuit Court of Winston County, Alabama, and the following are the names of all parties to the action: See Exhibit “A” Legal Description and their heirs or devisees, if deceased, whose whereabouts are unknown and which cannot be ascertained after the exercise of due diligence, and who are believed to claim some, right, title, interest or claim in and to the property described in Exhibit “A” which is attached hereto and incorporated herein as if set forth out in full.
All persons having an interest in said land or any portion thereof claiming any title thereto or any encumbrance or lien thereon, are hereby directed to plead, answer, demur or otherwise respond to the complaint on or before the 31st day of March, 2024 else at the expiration of 30 days thereafter suffer judgment by default or be rendered against them it being intended that his notice shall be used to perfect service against all parties who cannot be personally served with a copy of the complaint.
