NOTICE OF
FORECLOSURE SALE
Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Jacob Kennedy, a married man, to Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for LeaderOne Financial Corporation, its successors and assigns, on August 25, 2020, said mortgage being recorded in the Office of the Judge of Probate of Winston County, Alabama, on September 2, 2020 at Book 654, at Page 454. Data Mortgage Inc., DBA Essex Mortgage, the current holder, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash, in front of the main entrance of the Winston County Courthouse, in Double Springs, Alabama, on September 9, 2025, during the legal hours of sale, the following described real estate, situated in Winston County, Alabama, to-wit:
A tract of land in the NE ¼ of SE ¼ of Section 21, Township 9 South, Range 10 West, Winston County, Alabama, described as follows: To reach the starting point being at the Northeast corner of said NE ¼ of SE ¼ and run South along the east line of forty, a distance of 12 feet to a point on the south right-of-way line of County Road #11; thence South 88° 30 minutes West along the south right-of-way line of County Road# 11 a distance of 210 feet to the point of beginning; From point of beginning run South 1° 35 minutes East a distance of 210 feet to an old iron pin; thence South 88° 30 minutes West a distance of 210 feet to a point 5 feet west of the west edge of pavement of Co. Road #481; thence North 1° 35 minutes West generally along the pavement of Co. Road# 481, a distance of 210 feet to the South right-of-way line of Co. Road #11; thence North 88° 30 minutes East along the South right-of-way line of Co. Road #11, a distance of 210 feet to the point of beginning. LESS AND EXCEPT: 0.13 acres off the west side of parcel deeded to Winston County Commission Road System on January 9, 1987.
LESS AND EXCEPT: A twenty foot strip of land from the center of an existing road that runs in a Southerly direction off Littleville Road running the length of that part of the road that borders the above described property. This being a twenty foot strip on either side of the road making the entire width a 40 foot total strip. Lying and being situated in the NE ¼ of SE ¼ of Section 21, Township 9 South, Range 10 West, Winston County, Alabama. This road is known as County Road #481 (Muris Boshell/Cook/McCrary Road)
PARCEL 2: A parcel of land lying and being situated in the NE ¼ - SE ¼ of Section 21, Township 9 South, Range 10 West, Winston County, Alabama, and being more particularly described as follows: Commence at a 1 ¼ inch pipe marking the Southeast corner of Section 21 and run thence North 01° 15 minutes 04 seconds West along the East boundary of Section 21 a distance of 1317.57 feet to the Southeast corner of the NE ¼ - SE ¼; run thence North 01° 01 minutes 08 seconds East along the East boundary of the NE ¼ - SE ¼ a distance of 893.74 feet to a ½ inch steel rod; run thence North 88° 45 minutes 54 seconds West a distance of 210.00 feet to a 5/8 inch capped iron marking the point of beginning; thence continue North 88° 45 minutes 54 seconds West a distance of 153.86 feet to a 5/8 inch capped iron set for reference and being on the East side of a paved road; thence continue North 88° 45 minutes 54 seconds West a distance of 56.14 feet to a 5/8 inch capped iron; run thence North 01° 01 minutes 08 seconds East a distance of 210.00 feet to a 5/8 inch capped iron; run thence South 88° 45 minutes 54 seconds East a distance of 210.00 feet to a cut off sign post; run thence South 01° 01 minute 08 seconds West a distance of 210.00 feet to the point of beginning.

If the sale is set aside for any reason, the purchaser at the sale shall be only entitled to a return of the deposit and bid amount, if paid. The Mortgagee/Transferee reserves the right to bid for and purchase the real estate and to credit is purchase price against the expenses of sale and indebtedness secured by the real estate.
