ORDINANCE #2017-10
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HALEYVILLE, ALABAMA, AS FOLLOWS:
SECTION I. The said Mayor and City Council hereby find and declare that JRS Realty, LLC has filed with it, as the governing body of the City of Haleyville, a petition for the annexation of property owned by him in Marion County, Alabama, a true and correct copy of said petition, which is set forth below:

PETITION FOR ANNEXATION
Comes now the undersigned and hereby show and petition as follows:
Begin at a point that is 182.4 feet South 6 degrees 00 minutes East of the NE corner of Section 36, Township 9 South, range 11 West. Point being on the South ROW of North Alabama Railroad; thence continuing along same line a distance of 129.2 feet to the North ROW of Alabama Highway No. 5; thence in a westerly direction and along the North ROW of said highway a distance of 1380 feet to a point where the West line of the NE ¼ of NE ¼, Section 36, Township 9 South, Range 11 West, crosses said highway; thence North 6 degrees 00 minutes West and along said forty line a distance of 425 feet to a point on the South ROW of North Alabama Railroad; thence South 74 degrees 00 minutes east and along the South ROW of said railroad a distance of 1430 feet to the point of beginning. All land lying and being situated in the NE ¼ of NE ¼ Section 36, and the SE ¼ of SE 14 of Section 25, Township 9 South, Range 11 West, Marion County, Alabama, containing 10 acres, more or less.
Less and Except:
A tract or parcel of land lying and being situated in the NE ¼ of the NE ¼ of Section 36, and the SE ¼ of the SE ¼ of Section 25, Township 9, Range 11 West, Marion County, Alabama, being more particularly described as follows: Begin at the Southwest corner of the SE ¼ of the SE ¼ of Section 25, Township 9 South, Range 11 West; thence run North along the West boundary of said section 215 feet, more or less, to a point where said section line intersects with the Southern boundary of the North Alabama Railroad right-of-way, this being the point of beginning of the property herein described; thence run in a Southeasterly direction along the Southern boundary of the North Alabama Railroad right-of-way a distance of 800 feet; thence run South parallel with the Western boundary of said Section a distance of 200 feet; thence run in a Northwesterly direction parallel with the Southern boundary of the North Alabama Railroad right-of-way 800 feet, more or less, to a point lying and being on the Western boundary of the SE ¼ of the SE ¼ of Section 25, Township 9 South, Range 11 West, thence run North along the Western boundary of said Section 200 feet, back to the point of beginning. Such lands being 4 acres, more or less.
1. That the undersigned person is the owner of the property of the hereinafter described property located in Marion County, Alabama, which property is contiguous to the corporate limits of the City of Haleyville and hereby petitions the City of Haleyville under the provisions of Section 11-42-21, Code of Alabama, 1975, that the hereinafter described property be annexed to the City of Haleyville, thereby causing the municipality's corporate limits to be extended and re-arranged so as to embrace and include such property within the corporate limits of the City of Haleyville:

The undersigned attach hereto as Exhibit "A" a map of the territory showing its relationship to the corporate limits to the City of Haleyville to which said property is proposed to be correctly included and hereby certify that they are the owners of the hereinafter described property as defined in Section 11-42-20, Code of Alabama, 1975 as amended.

SECTION II. The said Mayor and City Council hereby grant said petition for annexation of the property described in said petition filed by JRS Realty, LLC hereby consent to the proposed annexation and orders that the corporate limits of the City of Haleyville, Alabama, shall be extended and re-arranged so as to embrace and include said property described in the petition as a part of the corporate limits of the City of Haleyville to become effective upon the date of publication of said ordinance.
It is further ordered that upon publication of said ordinance, the Clerk of the City of Haleyville shall file a description of the property to be annexed in the Office of the Judge of Probate of Marion County, Alabama.
