FOR VALIDATION OF OBLIGATIONS
TAXPAYERS AND CITIZENS OF THE TOWN OF LYNN, ALABAMA:
You are hereby given notice that the Town of Lynn, Alabama ( the “Town”) has filed a petition (the “Petition”) in the Circuit Court of Winston County, Alabama (67-CV-2020-
900076) under authority of Article 17 of Chapter 6 of Title 6 of the Code of Alabama 1975 and resolution of the Town adopted on August 17, 2020 (the “Authorizing Resolution”) requesting the Court to validate and confirm the authorization, delivery, and performance by the Town under authority of Amendment No. 772 to the Constitution of Alabama of 1901, as amended, of the agreements and obligations thereof under that certain Economic Development Agreement (the “Economic Development Agreement”) by and among Winston County, Alabama, the Town and The Industrial Development Authority of Winston County, Alabama, with respect to the economic development project referenced therein to be located within the corporate limits of the Town for the manufacture, assembly and storing of manufactured housing and related products. A certified copy of the Authorizing Resolution and the Economic Development Agreement are attached to the Petition and may be reviewed (and copies thereof made at personal expense) at the offices of the governing body of the Town during the regular business hours thereof. You, as taxpayers and citizens of the Town, are required, pursuant to Order of the Court, to show cause, if any you have, at a hearing of the Petition to be held at 9:30 a.m. on Friday, February 12, 2021 in the Bobby J. Aderholt Judicial Complex in the Town of Double Springs, Alabama, why the Economic Development Agreement and the obligations of the Town thereunder for the making of the Town Contribution, the means of payment provided therefor, and the covenants and agreements made for the benefit thereof, should not be validated and confirmed.
