approving the bid for the sale of
authorized under Ordinance
Whereas, the City declared the herein described property as surplus on December 6, 2021 in Ordinance #2021-04; and
Whereas, pursuant to said Ordinance, notice was given that the City would accept sealed bids until Wednesday, February 2, 2022; and
Whereas, pursuant to the notice, sealed bids were opened at 11:00 a.m. on February 2, 2022 at City Hall; and
Whereas, WRWEI Investment Properties, LLC was the highest bidder for cash at $252,000.00 Dollars; and
Whereas, the City had said property appraised by Richardson Real Estate and Appraisal Company. That said bid from WRWEI Investment Properties, LLC was in excess of the appraised value submitted to the City by Richardson Real Estate and Appraisal Company; and
Whereas, the legal description for the foregoing mentioned property is as follows:
Commence at the NW Corner of the Section 7, Township 10 South, Range 10 West and run thence South along the West boundary of Section 7 a distance of 300 feet, more or less to a point that is 50 feet west of the SW Corner of Lot 7 of Block 12 and the point of beginning of the property herein described; thence continue South along said West boundary of Section 7 a distance of 1030 feet more or less to the SW Corner of the NW ¼ of NW ¼; run thence East along the south boundary of the NW ¼ of NW ¼ a distance of 659.99 feet to a point; run then North 57 degrees 59 minutes 00 seconds East a distance of 371.46 feet to a ½ inch capped iron on the West side of the Old Delmar Road; thence run Northwesterly along the West side of Old Delmar Road a distance of 420 feet more or less to a point on the West side of Old Delmar Road; thence run South 84 degrees 18 minutes 45 seconds West a distance of 150.13 feet; run thence North 14 degrees 05 minutes 52 seconds West a distance of 22.39 feet to a point that is located at the center of an Alley (abandon) between the SE Corner of Lot 9 and the SW Corner of Lot 8 of Block 15 of the Howell Addition; run thence NW along the center of said Alley (abandon) 450 feet, more or less, to the center of said Alley between the SE Corner of Lot 7 and the SW Corner of Lot 6 of Block 13 of the Howell Addition; run thence Westerly along the South boundary of Lot 7 Block 13 and Lots 6 and 7 of Block 12 of the Howell Addition to the point of beginning. Whereas, the City Council finds that it is in the best interest of the City that the bid be accepted and that the property be sold on terms consist with this Ordinance.
Now, in consideration of the foregoing, bid in the amount of $252,000.00 Dollars for the herein described property is accepted by the City. The Mayor and Acting City Clerk are hereby authorized to execute the deed and such other documents as are necessary for the transfer of ownership of said property to the highest bidder, WRWEI Investment Properties, LLC.
