NOTICE OF
FORECLOSURE
Default having been made in the payment of indebtedness secured by that certain mortgage dated the 30th day of September, 2013, executed by Dylan Cleghorn, an unmarried man, and Darren Cleghorn, a married man, to Traditions Bank, which mortgage is recorded at Book 583, Page 109, in the Probate Records of Winston County, Alabama.
The undersigned has elected to declare the entire indebtedness secured by said mortgage to be due and payable as provided in said mortgage and notice is hereby given that pursuant to law and the power of sale contained in said mortgage, the undersigned will sell at public outcry, to the highest bidder for cash, in front of the Main Door of the Winston County Courthouse, City of Double Springs, Alabama, within the legal hours of sale, on the 25th day of March, 2025, the following described real estate situated in Winston County, Alabama, to-wit:
Commence at the Southeast Corner of the Southeast Quarter of the Northeast Quarter of Section 20, Township 11 South, Range 6 West. Thence West 300 (feet) to the Easterly R.O.W. of a Public Road; Thence Northeasterly
along said R.O.W. 153 (feet) to the Point of Beginning; Thence South 63 degrees-30 minutes East a distance of 150 (feet); Thence Northeasterly a distance of 211 (feet); Thence West a distance of 140 (feet) to said R.O.W.; Thence Southwesterly
along said R.O.W. a distance of 147 (feet) to the Point of Beginning. Said land lying in the Southeast Quarter of the Northeast Quarter of Section 20, Township 11 South, Range 6 West, Winston County, Alabama.
This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances,
and exceptions reflected in the mortgage and those contained in the records of the office of the Judge of Probate of the county where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
Said sale is made for the purpose of paying the same indebtedness and the expenses incident to this sale, including a reasonable attorney’s fee.
Pursuant to Ala. Code (1975) §6-5-248(h), Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances.
